Payment Processing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders and provides all customer service inquiries and handles returns.

All payments, billing inquiries, refunds, and subscription management are handled by Paddle. By making a purchase, you also agree to Paddle's Terms of Use and Privacy Policy.

Service Description

ModelPhotoAI is an AI-powered platform that generates professional model photography for fashion and e-commerce products. Our services include:

• AI model photo generation using uploaded product images

• Custom AI model creation from reference photos

• Scene generation and styling tools

• Video generation from AI-generated images

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

User Accounts

You must create an account to use our services. You agree to:

• Provide accurate and complete information during registration

• Maintain the security of your password and account

• Notify us immediately of any unauthorized access to your account

• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use

You agree not to use ModelPhotoAI to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable

• Create deepfakes, non-consensual intimate imagery, or content intended to deceive or defraud

• Upload images that you do not have the right to use

• Infringe on the intellectual property rights of others

• Attempt to reverse-engineer, decompile, or extract our AI models or algorithms

• Use automated systems (bots, scrapers) to access the service without our written consent

• Resell or redistribute access to the service without authorization

We reserve the right to remove content and suspend accounts that violate this policy without refund.

AI-Generated Content & Intellectual Property

You retain ownership of all images you upload to ModelPhotoAI. For AI-generated outputs:

• You are granted a perpetual, non-exclusive license to use AI-generated images for commercial and personal purposes

• We do not claim ownership of AI-generated outputs created from your inputs

• You are responsible for ensuring your use of generated content complies with applicable laws

• AI-generated content may not be perfectly accurate and should be reviewed before use in commercial contexts

ModelPhotoAI retains all rights to its platform, technology, AI models, and algorithms.

Credits & Billing

ModelPhotoAI operates on a credit-based system. Credits are used to generate AI content.

• Credits are purchased through subscription plans or one-time purchases processed by Paddle

• Credits are non-transferable between accounts

• Unused credits from monthly subscriptions do not roll over to the next billing period unless specified in your plan

• Prices are subject to change with reasonable notice; existing subscriptions will be honored until the end of the current billing period

• All billing disputes and refund requests should be directed to Paddle as the Merchant of Record

Disclaimers

ModelPhotoAI is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding:

• The accuracy, quality, or suitability of AI-generated content

• Uninterrupted or error-free operation of the service

• The results that may be obtained from the use of the service

• The security of data transmitted through the service

AI-generated images are produced algorithmically and may contain imperfections, artifacts, or inaccuracies.

Limitation of Liability

To the maximum extent permitted by applicable law, ModelPhotoAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of our services.

Our total liability for any claims arising from or related to these Terms or the service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Termination

You may terminate your account at any time by contacting us or through your account settings. We may terminate or suspend your account immediately, without prior notice, if you breach these Terms.

Upon termination:

• Your right to access the service will cease immediately

• Any unused credits will be forfeited

• We will delete your data in accordance with our Privacy Policy

• Sections that by their nature should survive termination will remain in effect

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration or the courts of competent jurisdiction.
